Terms of Service - Jumpwait

1. Agreement to Terms

By accessing or using Jumpwait, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

2. Description of Service

Jumpwait is a marketplace platform that enables businesses to create waitlists for their products or services, and allows users to join, trade, and bid on waitlist positions.

3. User Accounts

You must be at least 18 years old to create an account
You are responsible for maintaining the security of your account
You must provide accurate and complete information
One person or entity may not maintain multiple accounts
You are responsible for all activity under your account

4. Waitlist Rules

For Users

Each user may only hold one position per waitlist unless otherwise specified
Positions are non-transferable outside of the Jumpwait platform
Selling positions on external platforms is prohibited

For Businesses

Businesses must honor waitlist positions for legitimate product/service access
False or misleading waitlist information is prohibited
Businesses must comply with all applicable consumer protection laws

5. Trading and Payments

All transactions are processed through Stripe
Revenue split: 90% to seller, 5% to business, 5% platform fee
Payouts are processed within 7 business days after trade completion
Bids are binding commitments to purchase at the stated price
Sellers may accept or reject bids at their discretion
Prices must be in EUR (€) or local supported currency

6. Prohibited Activities

You may not:

Use bots, scripts, or automated tools to interact with waitlists
Manipulate pricing through fake accounts or fraudulent bids
Harass other users or engage in abusive behavior
Attempt to circumvent platform fees
Use the platform for money laundering or illegal activities
Resell positions obtained through fraud

7. Refunds and Disputes

Position trades are final once completed
Refunds may be issued if a waitlist is cancelled by the business
Disputes between users and businesses should first be resolved directly
Jumpwait may mediate disputes but is not liable for outcomes

8. Intellectual Property

The Jumpwait platform, including its design, features, and content, is protected by copyright and other intellectual property laws. Users retain ownership of content they create but grant Jumpwait a license to display and distribute it on the platform.

9. Limitation of Liability

Jumpwait is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability is limited to the fees paid by you in the past 12 months.

10. Termination

We may terminate or suspend your account at any time for violations of these terms. Upon termination, pending transactions will be handled on a case-by-case basis.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or platform notification. Continued use after changes constitutes acceptance of the new terms.
